接到TSCDY來函，談到什麼settlement ....，
一堆法律文字，懶得看，
請問看過的同學，這是啥東東？？？

有和解金可拿？？？

我也收到了,
-相關權利人(有資格領和解金的人) : April 18 2012~September 22, 2014期間, 有買入TSCDY ADRs and F shares;
-預期可領到的$ (重點): TSCDY ADRs0.41/share;
-有資格也決定要領的人必須在 May 5, 2016以前, 填寫完成所附的表單並寄回 (文件中有附地址)
詳細法律細節我也不太了 (求解強者同學)

Tesco has agreed to pay $12m (£8m) to settle a US lawsuit over the accounting scandal last year which saw its shares crumble.

US owners of American Depositary Receipts (ADRs), instruments which allow those across the Atlantic to hold shares in a non-US company, brought the class action lawsuit against the supermarket chain.

They were among the investors who suffered as Tesco’s shares lost over a quarter of their value within a fortnight after the supermarket admitted to an accounting scandal at the company.

The grocer will pay up $12m to settle the lawsuit, but it is not admitting any liability.

Tesco revealed last September that it had overstated its commercial income by £250m, due to the “accelerated recognition of commercial income and delayed accrual of costs”.

In layman's terms, the accounting error arose because of the way Tesco recognised and accounted for payments to suppliers, and the payments suppliers paid to the supermarket.
After re-examining its accounts, it later emerged that the income overstatement was higher than the initial £250m, at £326m.
This was equal to roughly a quarter of Tesco’s profits, and the scandal led to the departure of top staff, including its former chief executive Phil Clarke, and an internal investigation. A Serious Fraud Office inquiry into the company could last up to seven years.
The settlement is subject to confirmation by a federal court in New York. “The agreement, if confirmed, will settle one of two claims before US courts arising out of the commercial income overstatement,” Tesco said.
The second claim is being brought in Ohio by holders of ADRs, which Tesco says make up less than 0.2pc of the company’s total shares.

不知去哪裡下載？

I have contacted E*trade regarding did not receive any settlement notice and they suggest I should contact TESCO directly. I just send them an email, attached my trade confirmations and waiting for a reply.

YOUR LEGAL RIGHTS AND OPTIONS IN THIS SETTLEMENT

SUBMIT A CLAIM FORM	The only way to get a payment as part of this Settlement. The deadline to submit a claim is May 5, 2016.
EXCLUDE YOURSELF	Get no payment as part of this Settlement. This is the only option that allows you to be a part of any other lawsuit against Tesco and their affiliates involving the claims released by this Settlement. Exclusions must be postmarked no later than April 5, 2016.
OBJECT	Write to the Court about why you do not like the Settlement. Objections must be postmarked on or beforeApril 5, 2016.
GO TO A HEARING	Ask to speak in Court about the fairness of the Settlement at the Final Approval Hearing, to take place at2:00 p.m. on April 21, 2016.
DO NOTHING	Get no payment. You give up your right to bring an individual action.

根據文件第四頁1.如果買進後，2014/9/22之前就賣掉，是無法獲得賠償的。必須持有超過2014/9/22才能有賠償

收到通知，說我寄出的申請書未附上證明2014年12月19日仍未賣出，
需在2016年7月10日前提出。
擱在案頭幾天，以為是股東會通知，未注意。

(1)除了需附上2014年12月19日仍未賣出的證明.
(2)還有這一段 --
Your Claim must also calculate to a Recognized Loss under the Court-approved Plan of Allocation set forth in the Notice in order to be included in the list of eligible Claims presented to the Court for approval.
