Now, the shares are 14% higher in electronic trading, poised to continue their recent success. That is, during the past two months, Herbalife Ltd. has outdone the S& 500 Index (SPX) by 19 percentage points to settle yesterday at $40.09, and short-term speculators have been trading calls in response. HLF's Schaeffer's put/call open interest ratio (SOIR) of 1.06 is lower than 80% of readings from the past year. In other words, traders targeting options expiring within three months or less are far more call-skewed than normal.

Herbalife reported adjusted first-quarter earnings Tuesday of $109 million, or $1.29 a share, down from $151 million, or $1.50, in the same period last year. Analysts had expected earnings of $1.01 a share, which the company easily beat. Herbalife also raised its profit forecast for the year.

Herbalife Ltd.¡¦s stock rocketed higher in active trade Friday, after the company fanned hopes that a drawn-out probe by the Federal Trade Commission may be nearing an end.
The dietary and nutritional supplements company disclosed in a regulatory filing late Thursday: ¡§The company is currently in discussions with the FTC regarding a potential resolution of these matters.¡¨
Any resolution into the company¡¦s HLF, +20.52% methods of advertising, marketing, or sale of business opportunities, which was disclosed in March 2014, may come as a relief to shareholders, as it would give speculators betting against the stock one less thing to harp on. Billionaire hedge-fund manager Bill Ackman has gone to elaborate lengths, including publicly releasing a mini documentary, to push his belief that the company was operating a pyramid scheme.
The stock soared 23% in morning trade, putting it on course for its second-biggest one-day percentage gain since the company went public in December 2004. Volume in the first hour of the regular session was about 3.2 million shares, or nearly double the full-day average over the past 30 days, according to FactSet.

Investors didn¡¦t seem to care that the company stated it couldn¡¦t predict the timing of any resolution, or if it would have a ¡§material adverse impact¡¨ on its operations.
¡§The possible range of outcomes include the filing by the FTC of a contested civil complaint, further discussions leading to a settlement which could include a monetary payment and other relief or the closure of these matters without action,¡¨ the company stated in the filing. ¡§At the present time, the company is unable to estimate a range of potential loss, if any, relating to these matters.
In an ironic twist, the resolution may finally vindicate Ackman, who has been pushing regulators to investigate the company, but he could still see any profits he made on his bearish bets dwindle as that resolution removes an overhang.

They are now just 7% away from where they closed on March 12, 2014, when Herbalife said it received a Civil Investigative Demand from the FTC.
The company also reported late Thursday fourth-quarter results that beat profit and sales expectations, but cut its profit outlook for 2016, citing unfavorable currency market developments.

In spite of a spirited performance in almost all of his holdings, Bill Ackman (Trades, Portfolio)¡¦s Pershing Square portfolio missed a gain year to date mainly on the rally of his short position in Herbalife Ltd. (NYSE:HLF), according to his June report.

Ackman¡¦s fund edge down 1.5% in gross performance and 2.3% in net of fees, as returns for June slid 6.2% gross and 6.3% net. With his exit from the battered Valeant Pharmaceuticals in the first quarter, all but one of his stocks rose year to date. The best performers were Nomad Foods Ltd. (NYSE:NOMD), Restaurant Brands International (NYSESR) and Platform Specialty Products Corp. (NYSEAH). His only stock to end the quarter down, Mondelez International Inc. (NASDAQ:MDLZ), declined 1.71%.

His single short bet Herbalife jumped 49% since the start of the year, reaching $71.73 per share at close of trading on July 3. The company, which sells nutritional shakes through multi-level marketing, this year continued its defense against Ackman¡¦s takedown four and a half years ago when he accused it of being a pyramid scheme.

Herbalife has a plan that could squeeze hedge fund billionaire Bill Ackman

Hedge fund billionaire Bill Ackman's short position in Herbalife is looking awfully shaky.
First and foremost, the company's surging stock ¡X up 11% over two days after a report that it held talks to go public ¡X has cost the Ackman-led Pershing Square Capital Management roughly $115 million on a mark-to-market basis, according to data compiled by financial analytics provider S3 Partners.
And Ackman personally could be in for more pain due to Herbalife's decision to execute a so-called "modified Dutch auction," through which the company will buy back $600 million of shares at $60 to $68 a pop. Beyond that, all shareholders who sell back their stock will get an addition cash payment if Herbalife is acquired at a higher price than the auction range sometime in the next two years.
The buyback of 8.8 million to 10 million shares could actually end up squeezing Ackman out of some of his shorts, which he started accumulating five years ago while accusing Herbalife of operating as a pyramid scheme. S3 estimates that if the Dutch auction is fully tendered, Ackman could face 3 million to 5 million share loan recalls. After all, he makes up roughly 75% of the company's short interest.
But it doesn't end there. Once the number of Herbalife shares available to be loaned plummets following the auction, the cost to borrow the company's stock will "increase dramatically" from around 2% into the 10% to 40% area, according to S3.
So to what extent will that hurt Ackman's wallet? He currently pays about $63,000 a day in financing costs, but that could skyrocket to $300,000 to $1.2 million a day once the auction is complete, S3 says.
Long story short, the Dutch auction will hit Ackman from two angles: loan recalls and financing costs.
